A 1st time DUI arrest could happen to anyone, and could result in misdemeanor consequences, so long as there no accident resulting in injury or death. This charge can be reduced to a less serious DUI known as a wet-reckless (Cal. Veh. C. 23103/23103.5). 

A second DUI offense is punishable by at least 10 days in jail, up to 30 months of DUI school (and at a minimum 18 months of DUI school).

Penalties for a third DUI offense could include a 3-year license suspension, at least 120 days in the county jail, and designation as a habitual traffic offender. 

You could see anywhere from 180 days in jail to 3 years in the state prison, if you are convicted of a fourth DUI offense within 10 years. 

A DUI will automatically be accused as a felony if you cause great bodily injury or death, if you are facing a DUI offense with 3 prior convictions within 10 years of the newest arrest date, or if you were convicted of a felony DUI within 10 years of the arrest date. 

Almost every DUI arrest triggers the need for an APS hearing or administrative per se hearing.

An APS hearing addresses your driving privilege and must be fought independently from the criminal proceeding.
